I will have the bond of any officer that chooses to ignore my private contract with is on public record. Waters are public domain and it is impossible to trespass. It will hold up in a court of law. You just have to know how not to contract with them. Their trickery is the only thing they have to use against you and you provide it to them in the form of identification... If you don't know the law, you won't pick up on the sneaky questions they ask that could take away your rights should you provide the wrong answer. We have 5 enforcement (customs,sheriff,city,fwc,uscg) agencies actively working here so it's not unusual for one of them to try to board you on almost every trip on the water. As to the landowners objecting--they don't own the water and they don't own the view. The water and the view are public property, owned by all of us. Been to Boca Grande lately? Dry Tortugas? All over the keys? The state ends up paying out of the nose to have many of these derelict vessels hauled off in an envrionmentaly acceptable way, after years of expensive legal processes. Meanwhile, they are eyesores for everyone, including cruising boaters. Right in the Pilot Program law it is stated that any regulation created as part of the program must do several things, and one of those things is: "b. Promote public access to the waters of this state." It is impossible to imagine how limiting or outlawing anchoring can "promote public access."
